Big Tech loses its content impunity. A U.S. appeals court revived a lawsuit against TikTok, brought by the mother of a 10-year-old girl who accidentally hanged herself whilst doing a viral "blackout challenge." By allowing the lawsuit to continue, the presiding judges broke with the prevailing understanding that Section 230 of the Communications Decency Act immunizes tech companies from liability for any content posted by users on their platforms. In the published opinion, Judge Patty Shwartz explained that although social media platforms aren't liable for the content published on their platforms, they can be found liable for the content that their algorithms recommend to users. Although this ruling is likely to be challenged, this could be the start of the end of Big Tech's content impunity and herald a new era for social media, where algorithms are tuned for safety rather than engagement and harmful content is moderated with real force. For marketers, this would drastically minimize concerns around brand safety on social media, however it could raise censorship problems if it leads to direct government oversight of the underlying algorithms.
