📰 Latest Developments

A Big Tech breakup? Two weeks ago, in TMW #166, I pondered if we were about to see decades of overdue Big Tech regulatory action happen in weeks. Turns out, the answer is a resounding yes. Starting with the big kahuna, the US Department of Justice (DOJ) has filed an antitrust lawsuit against Apple, accusing the company of illegally using its power over iOS app distribution to prevent competitors from using hardware and software features on its devices, thereby making it harder for consumers to move to competing smartphones. This is a landmark move demonstrating that the DOJ has fully grasped just how interconnected the digital ecosystem is. Meanwhile over in France, the local competition watchdog fined Google €250M for training its AI models on news media content without publishers' consent; Google says it won’t challenge the fine. Staying in Europe, EU antitrust regulators are putting the DMA to use by probing Meta’s 'pay or okay' approach to consent collection, Google’s self-preferencing in search, and Apple’s anti-steering App Store behavior. It's not just the sheer avalanche of regulatory action that's eye-catching; it's also the severity of possible punishments, with US and EU regulators finally starting to talk openly about possible breakups for Big Tech. Regulators are baring their teeth; it's well overdue, but the future is starting to look brighter for marketers who are so reliant on the anti-competitive whims of the Big Tech ecosystem.
